MARCH 1999 - Beginning last month, a former disabled MDC officer - now state trooper - about whom we first reported over a year-and-a-half ago (July '97 Voice) has resumed work. Phil Lindsay, with two fellow disabled officers (Mike Shimkus and Bruce Buckley) who were cleared for work by the State Retirement Board, are now back with the State Police.

In 1997, Lindsay, along with Shimkus and Buckley, brought a law suit against the State Police to get their jobs back. Having entered as a party in the case, the State Police Association of Mass. recently sought an injunction to stop their return.

After a hearing on the matter, the state court did not grant the injunction, but directed that Lindsay and the others perform administrative duties until they complete retraining. "I'm glad to be back and overall I'm impressed with the work environment," says Lindsay.

"Everyone understands that it (return to work) is something of a first for this department so we're sort of feeling our way along." It's expected that Lindsay and the others will be entering the state police academy this month for retraining.

In a related matter, the Boston Firefighters Union is seeking an injunction against the Public Employee Retirement Administration Commission, that would protect disability retirees, who fail to file their earnings statement (Sec. 91A),from losing their pensions.
